dc.description.abstract In this note the decision in K v K 2008 5 SA 431 (W), where a divorce order was granted before the court first ensured that the children's best interests are taken care of satisfactorily, is criticised. The piecemeal fashion in which the court was prepared to deal with the different aspects of parental responsibilities and rights is alarming. The court clearly disregarded the constitutional court's admonition that courts must always function in a manner which at all times shows due respect for children's rights. en
