The aim of this article is to explore the legislative origin of adoption in South
Africa. It is common knowledge that South African law is based on Roman-
Dutch principles and that English law has also influenced our legal system. The
article starts off with a brief discussion of Roman and Roman-Dutch law,
whereafter South African law as it relates to the legislative introduction of
adoption in this country is discussed. Ultimately a conclusion is reached as to
the origin of adoption legislation in South Africa. |
