    The impact of organised contraband smuggled into correctional facilities in the Gauteng region

    The safety of correctional officials, criminals who are incarcerated, and people who are being held while awaiting trial are all seriously threatened by contraband in facilities. This study filled a gap in the literature in South Africa about the smuggling of contraband into correctional facilities. Data were collected at four correctional institutions among thirteen such facilities in the Gauteng region. In order to fully understand the phenomenon under inquiry, the researcher used a mixed-method approach, which combines both quantitative and qualitative methods of inquiry. The study examined contraband smuggling at the selected correctional facilities to address the topic under investigation. Correctional officials performed search and recovery operations to find and seize such unauthorized items after it was discovered that offenders were involved. The respondents, who comprised both inmates and officials, indicated that correctional officials, offenders, and visitors were conduits for contraband smuggling into correctional facilities. According to the data, inmates attacked correctional officials for gang-related reasons rather than problems with contraband. It was also discovered that in order to stop this pandemic, present policies and techniques to stop, identify, and remove contraband from correctional facilities need to be reassessed.

    An evaluation of the rehabilitation programmes for youth offenders at Boksburg correctional centre in Gauteng province of South Africa

    Correctional centres play a vital role in the rehabilitation of offenders. Since the beginning of the Covid-19 pandemic, crime has increased globally in countries the world over, especially youth crime, although commonly in relation to online activities. Youth offenders are the category of the South African incarcerated population that has been growing rapidly in the first decade of democratic South Africa and has been observed to be continually growing. Despite the efforts by the Department of Correctional Services to rehabilitate the offenders, South Africa’s criminal re-offending rate is at an approximate alarming rate of 87% and has partly been attributed to the rehabilitation programmes in correctional services which have been pointed to be absent or ‘problematic’. Rehabilitation programmes are one of the several endeavours which the Department of Correctional Services has embarked upon in its quest to rehabilitate offenders and reintegrate them into communities as law-abiding citizens. Rehabilitation focusing on offender development, education and training for the youth is therefore key to the prevention of recidivism. The study sought to evaluate the rehabilitation programmes for youth offenders at the Boksburg Correctional Centre in the Gauteng province of South Africa with a view to enhance its perceived impact in reducing re-offending. The objectives of the study were to determine the types of rehabilitation programmes that are rendered to youth offenders; assess the success factors of rehabilitation programmes; analyse the threats to the rehabilitation programmes; and to suggest recommendations that can be adopted to enhance the perceived impact of the rehabilitation programmes for the youth offenders. The study adopted the qualitative research approach and employed the case study design. Semi-structured interviews were conducted with two (2) educationists, one (1) social worker, one (1) religious officer, one (1) sports officer, and seven (7) youth offenders who were all purposively sampled. Data from the study was thematically analysed. Findings from the study revealed that correctional programmes, offender development programmes, and psychological, social and spiritual programmes are rendered to the youth offenders. The study also established that the success factors to the rehabilitation programmes include human resources, communication and facilities. It was further established that there are threats to the rehabilitation programmes such as communication, facilities, offender development training and financing. The study concluded that while rehabilitation programmes are rendered to the youth offenders, they do not seem compulsory. Further, the study concluded that there are gaps in the laws and regulations regarding participation and attendance of the youth offenders in the programmes, as well as gaps in skills development training programmes which contribute to the ineffectiveness of the rehabilitation programmes. The study recommended that the correctional centre introduces diversified educational programmes and offer skills development training and puts in place rules and regulations regarding the participation and attendance of the youth offenders in the rehabilitation programmes.

    Evaluasie van strategiese bestuur ten einde dienslewering te optimaliseer in die Suid-Afrikaanse Polisiediens

    Hierdie studie is gebaseer op die behoefte wat bestaan aan dienslewering wat regerings-departemente behoort te lewer en meer spesifiek ten opsigte van hierdie studie die diens wat die Suid-Afrikaanse Polisiediens (SAPD) lewer. Gevolglik is die primêre navorsingsdoelstelling egter om 'n evaluasie van strategiese bestuur te doen ten einde te bepaal watter bydrae en waarde dit kan hê vir die Suid-Afrikaanse Polisiediens ten einde dienslewering te optimaliseer. Hierdie studie vervul die volgende navorsingsdoelwitte:  Die waarde en belang van strategiese bestuur is bepaal,  Die waarde en belang van leierskap is bepaal,  Die waarde van organisasiekultuur is bepaal en die rol wat dit vervul ten einde dienslewering te optimaliseer. Die navorser het 'n nie-empiriese (teoretiese) navorsingsontwerp gevolg wat fokus op 'n sistematiese oorsig van nasionale media-artikels as bronne. Die navorser het vir die doeleindes van hierdie studie dokumentêre bronne, in die vorm van nasionale gedrukte media en persoonlike ondervinding gebruik as datainsamelingsmetode. Volgens Punch (2014:158) mag dokumentêre bronne vir data op verkeie maniere in die sosiale wetenskaplike navorsing gebruik word. Somige studies kan en mag moontlik totaal afhanklik wees van dokumentêre data, met hierdie data dan die fokus in eie reg. Hierdie studie het verder aanbevelings gemaak dat strategiese bestuur wel voordele inhou vir die Suid-Afrikaanse Polisiediens. Strategiese bestuur kan in enige organisasie toegepas word. Die waarde daarvan is dat organisasies wat strategies bestuur word, die eksterne invloede van die omgewing proaktief kan bestuur. Die sosio-politieke en ekonomiese omstandighede in Suid-Afrika maak beleidsaanpassings in openbare organisasies noodsaaklik as gevolg van die dinamiese verandering op hierdie terrein. Met die hulp van 'n strategiese plan kan bestuur die organisasie proaktief bestuur na gelang van wat die interne en eksterne omgewing vereis. Die lojale, effektiewe, opgeleide, doeltreffende leiers en polisiebestuurders behoort daardie beamptes te wees wat strategiese bestuur optimaal benut en daadwerklik toepas sodat doeltreffende dienslewering optimal aan die diverse gemeenskappe gelewer kan word. Dit blyk ook verder dat die strategiese bestuur en beplanningstegnieke waardevolle hulpmiddels is vir die professionele polisiebestuurder in terme van die verwesenliking van doelstellings en doelwitte van die Suid-Afrikaanse Polisiediens. Die strategiese plan (2014-2019) van die Suid-Afrikaanse Polisiediens bevat alle fokusareas wat nodig is vir sukses en die uitvoering daarvan op operasionele vlak bly die maatstaf. Daar word opsommend volstaan dat al vier geformuleerde hipoteses wetenskaplik geverifieer kon word in hierdie teoretiese literatuurstudie en dat al vier die geformuleerde hipoteses wat gestel is aan die begin van hierdie navorsing, wel aanvaar kan word vir die suksesvolle implementering van strategiese bestuur in die Suid-Afrikaanse Polisiediens ten einde dienslewering te optimaliseer. Hierdie navorsing lewer ‘n bydrae tot die kennis verwant aan ‘n meer strategiese rol van leiers om dienslewering te optimaliseer.

    Systematic review of theoretical and evidence-based literature on offenders' treatment in South Africa : a penological perspective

    The South African Department of Correctional Services has a legislative mandate of detaining offenders in safe custody whilst ensuring their human dignity amongst others. This stems from section 2 of the Correctional Services Act 111 of 1998 as amended. In addition to that, chapter 3 of this Act makes provision for conditions under which offenders should be treated, conditions of human dignity. This piece of legislation is effectively giving effect to the Bill of Rights as articulated in chapter two of the Constitution of the Republic of South Africa of 1996. It is expected of the department to treat offenders according to the provisions of not only this Constitution and Correctional Services Act 111 of 1998 as amended but also to comply with the international conventions and treaties. Extensive empirical and non-empirical studies on the treatment of offenders have been conducted by various scholars in the field of penology but not much has been done to bring to the fore knowledge with regard to the developmental trend of the treatment of offenders. It is against this backdrop that a qualitative study through systematic review of literature was conducted to bring together and examine available literature. In other words, a systematic literature review was conducted to determine if there is a developmental trend towards the treatment of offenders in South Africa as required by the prescripts of the law. Furthermore, this study was conducted to also demonstrate the researcher’s knowledge in the field of penology. The focus was on the central theories identified as offenders’ rights. The Department of Correctional Services identified eight offenders’ rights and sees them as its Constitutional mandate (Department of Correctional Services, 2013:8). This study has found a violation of the offenders’ right to equality to be diminishing over time. Apart from that, this study reveals a substantial violation of offenders’ rights because out of seven offenders’ rights, only one [freedom of religion] appears be successfully protected and promoted by the department. This study further present the recommendations and suggested areas of further research.

    Organisasievernuwing : 'n penologiese perspektief

    Die tradisionele benadering tot bestuur het die Suid-Afrikaanse korrektiewe sisteem sedert sy ontstaan gedomineer. Die vraag wat ontstaan, is of daar enige praktiese, werkbare altematiewe is, veral omdat die huidige strategiese ingesteldheid, argitektuur en menslike hulpbronne onder verdenking is. Hierdie navorsing bevestig die vermoede dat 'n nuwe benadering tot strategie, struktuur, kultuur, bestuursfilosofie, werkspraktyke en mense te voorskyn kom en dat dit alleenlik gemobiliseer kan word deur organisasievernuwing. 'n Penologiese sisteem wat 'n deelnemende bestuursbenadering aanvaar, sal as 'n wereldleier geklassifiseer word.
