The first form of litigation in ancient times was by way of accusatorial process. Later on the inquisitorial process also gained acceptance, and although some countries use an accusatorial and
others an inquisitorial system, the difference between them faded with time. Most countries like Namibia and South Africa, adopted a mixed system with both accusatorial and inquisitorial features in the systems.
Statements of state witnesses were protected from disclosure since 1954, but since 1993 a multitude of applications for disclosure were made to the courts. Initially they were refused but subsequent decisions ordered either full disclosure or disclosure of summaries of the affidavits. The constitutional court terminated the uncertainty in 1995 when it ordered full disclosure of the statements. The international position is also not consistent at all. In some countries disclosure is almost non-existent, while in others there is full disclosure or at least partial disclosure.

geskied. Die internasionale posisie is ook geensins eenvormig nie. In sommige lande is daar
feitlik geen blootlegging nie, terwyl ander weer volle of immers gedeeltelike blootlegging het.

This study investigated methods of recruiting and the identification of potential of prospective
trainee chartered accountants. The first five chapters deal with a literature study of local and
international sources on the recruiting and selection of trainee chartered accountants, whereupon
an empirical study involving the big eight auditing firms in South Africa was undertaken to examine
their recruiting and selection methods.
The five most important success indicators are academic ability, communication and interpersonal
skills, adaptability, team player/functioning in a group context and drive/performance orientation.
The evaluation of these attributes should, however, take place on a more scientific basis and
psychometric testing and competency based analysis should be applied.
Success indicators identified specifically for black accountants are drive and motivation,
leadership, communication and interpersonal skills, sensitivity for different cultures and exposure
to the western business environment.

Die doel van hlerdie ondersoek is om die ekstrinsieke en intrinsieke oorsake van
leermislukking met spesifieke verwysing na skole in die Windhoek stadsgebied te bepaal
en om aanbevelings te doen hoe om leermislukking teen te werk.
Leermislukking en druiping is onrusbarend hoog in skole in die Windhoek stadsgebied.
Nadat die Ministerie van Onderwys die semi-outomatiese promoveringstelsel ingestel
het, het druiping afgeneem maar leermislukking het toegeneem omdat leerders
gepromoveer word sonder dat hulle sukses in die vorige graad behaal het. Volgens die
literatuurstudie le die oorsake van leermislukking by die ouerhuis, die skool, die
omgewing en in die leerder self.
Die empiriese ondersoek toon ooreenkomste met die literatuurstudie wat betref die
oorsake van leermislukking. Om die oorsake teen te werk
- moet onderwysers beter opgelei word
- moet die ouers meer bewus gemaak word van hulle rol in die leersukses van hulle
kinders
- is meer skoolgeboue en onderwysers nodig om kleiner klasse te bewerkstellig.
The purpose of this research is to establish the extrinsic and intrinsic causes of learning
failure with specific reference to schools in the Windhoek municipal area and to make
recommendations to counteract learning failure.
Learning failure and grade failing are disconcertingly high in schools in the Windhoek
municipal area. After the Ministry of Education implemented the semi-automatic
promotion system, grade failing decreased, but learning failure increased because
learners are promoted without achieving success in a prior grade. According to the
literature study, the causes of learning failure are to be found in the home, the school,
the environment, and the learner.
Similarities regarding the causes of learning failure were found in the empirical
investigation and the literature study. To counteract these causes
• teachers should be better trained
• parents should become more aware of their role in the learning success of their
children
• more school buildings and teachers are needed to limit class sizes.

The motivation of staff in higher education institutions, especially In Zimbabwe,
has not received due attention over the years. This study investigated the factors
affecting staff motivation at a Teachers' College in Zimbabwe. Staff perceptions of
factors they found motivating and demotivating were established through the use
of a qualitative methodology in which the semi-structured interview was used as
the dominant method. Participant observation and the informal unstructured
interview were employed in a complementary manner. The findings indicated that
the factors respondents found motivating were those that tended to alleviate the
needs for recognition, appreciation and self-actualisation. Demotivating factors
included management policy and style, decision-making procedures and
administration. The findings are discussed in the context of some dominant
theories of motivation and recommendations are made regarding strategies to be
used and what further research can be undertaken to address the problem.
